Why does my patio slope back toward the house?
It settled that way. An old patio poured on dirt or loose fill sinks unevenly as the ground under it heaves and washes out, and the low side often ends up against the house. Water then runs at the foundation instead of away from it. A replacement resets the slope on a compacted base so the patio sheds water out into the yard.

Two things do that here. Frost lifts a slab that has no proper base under it, and a patio with no control joints cracks wherever the stress lands. We pour on a compacted stone base and saw-cut joints so the concrete cracks along the lines we choose instead of wandering across the surface.
Do I need to tear out the old patio or can you pour over it?
If the old slab is cracked, heaved, or sitting on a failed base, pouring over it just carries those problems up into the new surface. We tear the old patio out, rebuild the base, and pour fresh. An overlay only makes sense on a sound slab, and a patio that already moved is not sound.
